Our work is based exclusively on the General German Freight Forwarding Terms and Conditions 2017 (ADSp 2017), and – where they do not apply to the provision of logistics services – on the Logistics GTCs. Our General Terms and Conditions of Business concerning impediments to performance and force majeure shall apply additionally in the event of impediments to performance, i.e. force majeure, civil unrest, acts of war or terrorism, natural disasters, pandemics (e.g. Covid-19), epidemics, industrial action (strikes, lockouts, etc.), failure or restriction on electronic data exchange caused by third parties, cybercrime perpetrated by third parties, blocking of transport routes and other unforeseeable, unavoidable and serious events.

Important note: Section 23 of the General German Freight Forwarding Terms and Conditions 2017 (ADSp 2017) differs from the maximum amount of liability for damage to goods (German Commercial Code HGB, section 431), by limiting liability in multimodal transport – including carriage by sea and an unknown place of damage – to 2 SDR per kilo; furthermore it also limits standard liability of 8.33 SDR per kilo to EUR 1.25 million per claim and EUR 2.5 million per damaging event, albeit with a minimum of 2 SDR per kilo. Cross-border transport is also subject to CMR (Convention on the Contract for the International Carriage of Goods by Road).
